Software LicenseMagePhobia LLC, hereinafter referred to as "MagePhobia" is protected by the law copyright holder of the Software that include, but not limited to the website and its connected technology unless protected by other License, hereinafter referred to http://www.magephobia.com , and software packages MagePhobia commercially distributes. Infringement(s) of this Agreement will be prosecuted according to current Intellectual Property Protection law. MagePhobia reserves the right to revoke the Software License without agreement from any 3rd party Software user, hereinafter referred to Licensee.
By purchasing any media content, service, or software package for the website Licensee agrees to comply with the Software License.
By purchasing any software package in qty of 1 (one) Licensee is allowed to use 1 (one) package total for all Licensee's production servers. In case Licensee uses more than 1 production server where the package is needed Licensee is required to purchase additional Software License by purchasing additional qty of packages needed to fulfill production server needs. Licensee is free to use as many copies of the software as needed on local/staging/qa/development machines. Licensee is not allowed to re-use any of the Software code, partially or fully, in production purposes without acquiring needed Software License.
Any distribution of the Software, including non-commercial, is regarded as violation of this Agreement and will be prosecuted by current Intellectual Property Protection law.
It is strictly prohibited to redistribute/republish/reuse/duplicate and/or commercially utilize in any form without License any Software Packages.
MagePhobia reserves the right to publish any of the Software users on the website for reference purposes.
Licensee is prohibited from removing copyright notice and therefore legal liability of Software usage per this agreement from any usable code of the Software. Licensee reserves the right to terminate Software License Agreement with MagePhobia in its sole discretion.
In case MagePhobia sends written notice about termination of the Agreement Licensee is required to remove the Software from all kind of storage, servers, emails within 5 Business days and the confirmation of such actions should be in writing provided to MagePhobia via ticketing system, email, or Contact Us form, otherwise Licensee accepts all liability for using unlicensed Software and pay all reasonable MagePhobia costs including attorney cost to revoke the Software from Licensee.
Any Software Package is designed to work with a specific Magento edition. Licensee is not allowed to use versions of Magento other that stated during purchase of the Software. MagePhobia reservves the right not to provide any sort of Software support in case instructions of usage are not followed by Licensee.
Software can automatically connect with MagePhobia License server to validate Software License and/or collect system information to be used to help with supporting Licensee or MagePhobia's marketing purposes.
MagePhobia is not responsible for any damages that include, but not limited to direct/indirect/incidental/consequential that Software may cause. Please use at your own risk.
MagePhobia cannot be liable and prosecuted by usage of the Software against law or any illegal use.
MagePhobia reserves the right to revise/change Software License Agreement at any time without invalidating Licenses of existing Licensees. Any changes take immediate effect after publishing.
MagePhobia reserves the right to transfer, sub-contract or commercially delegate its obligations under Software License without approval or any sort of knowledge from Licensees.
Technical, Bug Fix, Upgrade Support30 days free support is offered as complimentary service for all Software packages sold via the website. All requests will be prioritized and handled based on the workload MagePhobia development team is upon.
MagePhobia offers free complimentary updates within 1 year after the original purchase of the Software. Updates are available within Licensee's account area. Past expiration of complimentary free 30 days support period MagePhobia can no longer offer upgrade support and any kind of other technical support. Additional technical support services can be purchased separately based on a separate quote.
Refund PolicyMagePhobia reserves Licensee's right to request refund. Licensee is required to provide explanation to the request allowing MagePhobia Support Depertment to respond to the inquery. Licensee should allow reasonable timeframe for MagePhobia Support Team to respond (normally within 24 hours during business days) before requesting refund.
If refund has been issued the Software must be removed from all kind of storage, servers, emails and the confirmation of such actions should be in writing provided to MagePhobia via ticketing system, email, or Contact Us form. MagePhobia reserves 3 business days to process refund. Requests that are received past 30 days will NOT be fulfilled regardless of the reason. Cost of installation, customization and any kind of additional services that were purchased based on separate quote are not refundable.
Website License.Unless otherwise stated, MagePhobia LLC, hereinafter referred to as "MagePhobia", owns intellectual property rights of the website, hereinafter referred to http://www.magephobia.com , its information, and its content that include, but not limited to media, attachments, software packages available for download.
It is allowed to view and print pages for reference/informational purposes only. It is also allowed to digitally store pages to be used offline as a reference. It is strictly prohibited to redistribute/republish/reuse/commercially utilize in any form/duplicate/edit/modify any content or media of the website. Magephobia is not responsible for any outdated content.
